By downloading, installing, accessing, or using the Beard Grow mobile application ("App," "Service," or "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

These Terms apply to all users of the App, including but not limited to casual browsers, registered users. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting within the App or on our website.

2. DEFINITIONS

For the purposes of these Terms, the following definitions apply:

• "App" or "Service": The Beard Grow mobile application, including all features, content, and functionality
• "User Content": Any photos, information, data, text, or other materials submitted by users
• "AI Analysis": The artificial intelligence-powered beard analysis and recommendations provided by the App using Firebase AI and Google's Generative AI models
• "Account": Your registered user profile and associated data accounts
• "Third-Party Services": External services integrated with the App, including Firebase, Google Sign-In, Apple Sign-In, and Google AI services
• "Intellectual Property": All copyrights, trademarks, patents, trade secrets, and other proprietary rights
• "Force Majeure Event": Any event beyond our reasonable control, including natural disasters, government actions, or technical failures
• "Snapshot": A comprehensive analysis and image set created for long-term progress tracking
• "Consent Records": Records of user consent to legal documents maintained for compliance purposes

3. DESCRIPTION OF SERVICE

Beard Grow is an AI-powered mobile application designed to provide personalized beard analysis and tailored care recommendations. The Service utilizes advanced machine learning algorithms and computer vision technology through Firebase AI and Google's Generative AI models to analyze user-submitted photographs and questionnaire responses.

3.1 Core Features

• Multi-Angle Photo Capture: Guided photo capture system for front, left profile, right profile, and under-chin views using device camera
• AI-Powered Analysis: Comprehensive beard health assessment using Firebase AI and Google's Generative AI models
• Personalized Care Plans: Customized grooming routines and product recommendations based on AI analysis
• Progress Tracking: Historical analysis and improvement monitoring with snapshot functionality
• Detailed Reports: Comprehensive beard health reports with analysis results and recommendations
• Educational Content: Beard care tips, tutorials, and best practices
• Cross-Platform Authentication: Support for Google Sign-In and Apple Sign-In access

3.2 Technical Infrastructure

The Service is built on Google's Firebase platform and includes:

• Firebase Authentication: Secure user authentication and account management
• Firebase Firestore: Real-time database for storing user data and analysis results
• Firebase Storage: Secure cloud storage for images and analysis data
• Firebase AI: AI processing capabilities using Google's Generative AI models
• Firebase Analytics: Usage analytics and app performance monitoring
• Firebase Crashlytics: Crash reporting and app stability monitoring
• Firebase Messaging: Push notifications for user engagement
• Firebase App Check: App authenticity verification and security

3.3 Service Availability

We strive to maintain continuous service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

4. ELIGIBILITY AND ACCOUNT REGISTRATION

5. USER OBLIGATIONS AND CONDUCT

5.1 Lawful Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You must comply with all applicable local, state, national, and international laws and regulations.

5.2 Content Submission

When uploading photos or other content to the App, you represent and warrant that:

• You have the legal right to upload and share such content
• The content does not violate any third-party rights, including privacy, publicity, or intellectual property rights
• The content is not obscene, defamatory, harassing, or otherwise objectionable
• The content does not contain malicious code, viruses, or other harmful elements
• You are the person depicted in any submitted photographs
• You understand that photos will be processed by AI systems for analysis purposes

5.3 Prohibited Activities

You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to the App, its systems, or user accounts
• Interfere with or disrupt the proper functioning of the App
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the Service
• Submit false, misleading, or inaccurate information
• Impersonate any person or entity
• Collect or harvest user information without consent
• Use the Service for commercial purposes without authorization
• Circumvent any security measures or access controls
• Abuse the AI analysis system or attempt to manipulate results

6. INTELLECTUAL PROPERTY RIGHTS

6.1 Our Intellectual Property

The App and its original content, features, functionality, algorithms, and design are owned by Eugene George and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. This includes but is not limited to:

• Source code and software architecture
• AI algorithms and machine learning models
• User interface and user experience design
• Trademarks, logos, and brand elements
• Content, text, graphics, and multimedia elements
• Database structure and organization
• Integration with Firebase and Google AI services

6.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include any right to:

• Modify, distribute, or create derivative works
• Reverse engineer or attempt to extract source code
• Remove or alter proprietary notices
• Use our intellectual property for commercial purposes
• Access or use Firebase services independently of the App

6.3 User Content License

By uploading content to the App, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, store, display, reproduce, modify, and distribute your content solely for the purpose of:

• Developing new features and functionalities

6.4 Trademark Policy

"Beard Grow" and associated logos are trademarks of Eugene George. You may not use our trademarks without prior written consent, except as necessary to identify the App in accordance with accepted practices.

6.5 Copyright Infringement

We respect intellectual property rights and expect users to do the same. If you believe your copyright has been infringed, please contact us at support@beardgrow.org with detailed information about the alleged infringement.

7. AI ANALYSIS AND MEDICAL DISCLAIMER

7.1 Nature of AI Analysis

Our AI analysis:

• Provides general observations about beard appearance and characteristics
• Offers grooming and care suggestions based on visual analysis
• Uses Firebase AI and Google's Generative AI models that may have limitations and biases
• Should not replace professional consultation for health concerns
• Is based on machine learning algorithms that continuously improve but may contain errors
• Processes images through Google's AI infrastructure with appropriate security measures

7.2 Limitations and Accuracy

You acknowledge and agree that:

• AI analysis results may not be 100% accurate or reliable
• Results are based on visual analysis of photographs and may not reflect actual conditions
• Environmental factors, photo quality, and lighting may affect analysis accuracy
• Our algorithms are continuously improving but may contain errors or limitations
• Firebase AI and Google's Generative AI models have their own limitations and constraints
• Analysis results may vary between different sessions or image submissions

7.3 Professional Consultation

Always consult with qualified healthcare providers, dermatologists, or other medical professionals for:

• Any skin conditions, irritations, or health concerns
• Persistent beard or skin problems
• Allergic reactions to grooming products
• Medical advice regarding hair growth or skin health
• Any concerns about changes in your beard or skin condition

7.4 Product Recommendations

Product recommendations provided by the App are general suggestions and may not be suitable for all users. We are not responsible for any adverse reactions or outcomes from using recommended products. Always read product labels and consult professionals if you have allergies or sensitivities.

8. PRIVACY AND DATA PROTECTION

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our comprehensive Privacy Policy, which is incorporated into these Terms by reference.

8.1 Data Collection and Use

By using the App, you consent to our collection and use of your information as described in our Privacy Policy, including:

• Photos and biometric data for AI analysis through Firebase AI
• Account and profile information stored in Firebase Firestore
• Usage data and analytics collected through Firebase Analytics
• Device and technical information for app functionality
• Crash reports and performance data through Firebase Crashlytics
• Consent records for legal compliance purposes

8.2 Data Security

We implement industry-standard security measures to protect your data, including Firebase's enterprise-grade security infrastructure. However, no system is completely secure, and you acknowledge the inherent risks of data transmission and storage.

10. PROHIBITED USES AND CONTENT

10.1 Prohibited Content

You may not upload, submit, or transmit content that:

• Is illegal, harmful, threatening, abusive, or discriminatory
• Violates any person's privacy, publicity, or other rights
• Contains nudity, sexually explicit material, or inappropriate content
• Infringes on intellectual property rights
• Contains false, misleading, or deceptive information
• Promotes violence, hatred, or illegal activities
• Contains malware, viruses, or other harmful code
• Violates any applicable laws or regulations
• Could compromise the security or functionality of Firebase services

10.2 Prohibited Activities

You may not:

• Use the App for any commercial purpose without authorization
• Attempt to circumvent security measures or access controls
• Interfere with other users' use of the App
• Create multiple accounts to evade restrictions
• Use automated tools or scripts to access the Service
• Attempt to reverse engineer or extract proprietary information
• Engage in any activity that could damage or impair the Service
• Abuse or overload Firebase services or Google AI models
• Attempt to access unauthorized areas of the App or its infrastructure

10.3 Content Moderation

We reserve the right, but have no obligation, to monitor, review, or remove user content that violates these Terms. We may take appropriate action, including account suspension or termination, for violations.

11. DISCLAIMERS AND WARRANTIES

11.1 Service Availability

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of any products, services, or information obtained through the Service will meet your expectations
• Any errors in the App will be corrected
• Firebase services or Google AI models will be continuously available
• Third-party integrations will function without interruption

11.2 AI Analysis Disclaimer

We specifically disclaim any warranties regarding:

• The accuracy, completeness, or reliability of AI analysis results
• The suitability of recommendations for your specific needs
• The effectiveness of suggested products or routines
• Any health or medical outcomes from using the Service
• The performance or availability of Firebase AI or Google's Generative AI models
• The consistency of AI analysis results across different sessions

11.3 Third-Party Content and Services

We disclaim all responsibility for third-party content, services, or websites accessible through the App. Your interactions with third parties are solely between you and such third parties.

12. LIMITATION OF LIABILITY

12.1 Types of Excluded Damages

Our liability exclusions include, but are not limited to:

• Personal injury or property damage
• Lost profits or business opportunities
• Data loss or corruption
• Service interruptions or downtime
• Third-party actions or content
• Security breaches or unauthorized access
• Errors in AI analysis or recommendations
• Firebase service failures or limitations
• Google AI model unavailability or errors
• Authentication service failures

12.2 Maximum Liability

In jurisdictions where liability cannot be excluded, our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of:

• The amount you paid to us in the 12 months preceding the claim (if any)
• One hundred dollars ($100 USD)

12.3 Time Limitation

Any claim against us must be brought within one (1) year after the cause of action arises, or such claim will be permanently barred.

12.4 Basis of the Bargain

You acknowledge that we have set our prices and entered into these Terms in reliance upon the disclaimers of warranty and limitations of liability set forth herein, and that the same reflect the allocation of risk between the parties.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Eugene George, Beard Grow, and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your User Content caused damage to a third party
• Your negligent or wrongful conduct
• Any false or misleading information you provide
• Your misuse of Firebase services or Google AI models
• Any violation of third-party service terms through your use of the App

This defense and indemnification obligation will survive these Terms and your use of the Service. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

14. TERMINATION AND SUSPENSION

14.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in the App settings (when available)
• Contacting us at support@beardgrow.org
• Uninstalling the App from your device

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security reasons
• Abuse of Firebase services or Google AI models
• At our sole discretion

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and associated data
• You remain liable for any charges incurred before termination
• Provisions that by their nature should survive will continue in effect
• Your data will be handled according to our Privacy Policy
• Consent records may be retained for legal compliance purposes

14.4 Data Retention After Termination

After account termination, we may retain certain information as described in our Privacy Policy and as required by law. You may request complete data deletion subject to legal and operational requirements.

15. DISPUTE RESOLUTION AND ARBITRATION

15.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@beardgrow.org to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes through direct negotiation.

15.2 Binding Arbitration

If informal resolution fails, any disputes arising from these Terms will be resolved through binding arbitration under the Arbitration and Conciliation Act, 2015 of India. The arbitration will be conducted by a single arbitrator mutually agreed upon by both parties.

15.3 Arbitration Rules

• Location: Arbitration will be conducted in Kannur, Kerala, India
• Language: Proceedings will be conducted in English
• Costs: Each party will bear their own costs and fees
• Award: The arbitrator's decision will be final and binding

15.4 Class Action Waiver

You agree that any arbitration will be conducted on an individual basis and not as part of a class, collective, or representative action. You waive any right to participate in class action lawsuits or class-wide arbitrations.

15.5 Exceptions to Arbitration

The following disputes are not subject to arbitration:

• Intellectual property disputes
• Small claims court matters within jurisdictional limits
• Injunctive or equitable relief

16. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India and the state of Kerala, without regard to conflict of law principles. For matters not subject to arbitration, the exclusive jurisdiction shall be the courts of Kannur, Kerala, India.

16.1 International Users

If you are accessing the Service from outside India, you are responsible for compliance with local laws. These Terms do not override mandatory consumer protection laws in your jurisdiction.

16.2 Export Controls

The Service may be subject to export controls and trade sanctions. You agree to comply with all applicable export control and trade sanctions laws.

17. MODIFICATIONS TO TERMS

17.1 Right to Modify

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the App
• Sending push notifications through Firebase Messaging to registered users
• Sending email notifications to registered users
• Displaying prominent notices in the App
• Requiring acceptance for significant changes
• Updating consent records for compliance tracking

17.2 Effective Date

Modified Terms will become effective immediately upon posting unless otherwise specified. Your continued use of the App after changes constitutes acceptance of the new Terms.

17.3 Rejection of Changes

If you do not agree to modified Terms, you must stop using the App and may terminate your account. Continued use after changes indicates acceptance.

18. FORCE MAJEURE

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters, earthquakes, floods, or severe weather
• War, terrorism, civil unrest, or government actions
• Internet outages, server failures, or cyber attacks
• Pandemics, epidemics, or public health emergencies
• Labor strikes, shortages, or disputes
• Third-party service failures or interruptions (including Firebase or Google AI services)
• Changes in third-party service terms or availability

During force majeure events, we will make reasonable efforts to minimize service disruptions and will resume normal operations as soon as reasonably possible.

19. SEVERABILITY AND WAIVER

19.1 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the original intent.

19.2 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

19.3 Survival

Provisions that by their nature should survive termination will survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification obligations.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and us regarding the use of the Service. These Terms supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.

20.1 Amendments

No amendment to these Terms will be effective unless made in writing and signed by both parties, except for modifications made by us as described in Section 17.

20.2 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section will be void.
